No one should be passed over, paid less, harassed, or fired because of who they are. California's Fair Employment and Housing Act (FEHA) is broader than federal law and protects workers at employers with five or more employees.
Consultations are free and confidential, and you pay no attorney's fees unless we win your case. If we don't win, you owe nothing, including case costs.
Race (including traits historically associated with race, such as hair texture and protective hairstyles), color, religion (including religious dress and grooming), national origin, ancestry, sex, gender, gender identity, gender expression, sexual orientation, pregnancy and related conditions, age (40 and over), physical disability, mental disability, medical condition, genetic information, marital status, military or veteran status, and reproductive health decision-making.
Firing, demotion, or refusal to hire or promote. Lower pay for the same work. Worse schedules, assignments, or discipline than coworkers. Refusing a reasonable accommodation for a disability, pregnancy, or religious practice. Failing to engage in a good-faith conversation (the "interactive process") about accommodation.
Most employers don't admit discrimination. Cases are often proven with circumstantial evidence: timing, inconsistent explanations, comments by decision-makers, and how similarly situated coworkers were treated. Depending on the case, you may recover lost wages and benefits, future lost earnings, emotional distress damages, punitive damages, and attorney's fees.
FEHA claims start with a complaint to the California Civil Rights Department, generally within three years of the discriminatory act. You can request an immediate right-to-sue notice and then have one year to file a lawsuit. We handle these filings.
I work for a small company. Am I covered? FEHA's discrimination protections apply to employers with five or more employees. Harassment protections apply to employers of any size.
Do I need proof in writing? No. Your own account, witnesses, and patterns of treatment are evidence. Keep notes with dates. Call (818) 904-0100 for a free, confidential consultation.
