Uninsured and Underinsured Driver Accident Lawyer

Hit by a Driver With No Insurance or Too Little?

Being hit by a driver with no insurance, or with only the bare minimum, doesn't necessarily mean you're out of options. In many cases, your own policy is the path to compensation.

Consultations are free, and you pay no attorney's fees unless we win your case. If we don't win, you owe nothing, including case costs.

Uninsured and Underinsured Motorist Coverage

Uninsured motorist (UM) coverage pays for your injuries when the at-fault driver has no insurance, or in a hit-and-run. Underinsured motorist (UIM) coverage helps when the at-fault driver's coverage isn't enough. California insurers must offer UM coverage, and it is included unless you rejected it in writing. Check your declarations page, or call us and we can help you review it.

Why This Matters in California

California's minimum liability coverage is $30,000 per person and $60,000 per accident for bodily injury (since January 1, 2025). A hospital stay or surgery can exceed that quickly. Underinsured motorist coverage can fill the gap.

Your Insurer Is Not on Your Side in a UM Claim

Even though it's your own policy, your insurance company acts like the other driver's insurer in an uninsured or underinsured motorist claim, and it will look for reasons to pay less. Many of these disputes go to arbitration under the policy terms, and policies have notice and documentation requirements.

Other Sources of Recovery

The at-fault driver's personal assets (often limited); an employer, if the driver was working at the time; a vehicle owner who let an unlicensed or unsafe driver use the car; and medical payments (MedPay) coverage on your own policy, if you have it.

Uninsured Driver FAQs

The driver fled the scene. What do I do? Call the police and report it right away. Hit-and-run claims under your uninsured motorist coverage often require prompt reporting. Then call a lawyer.

How long do I have? Most injury claims have a two-year deadline in California, and your policy may set its own notice requirements, so act quickly. Call (818) 904-0100 for a free consultation.
